MISTNOVEL TERMS OF USE

Welcome to MistNovel, a storytelling platform operated by AYA Pte. Ltd. ("we," "us," "our"). These Terms of Use (these "Terms") govern your access to and use of MistNovel's website, mobile application, and services (collectively, the "Service").

By using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use the Service.

1. ELIGIBILITY & ACCOUNTS

1.1 Age Requirement You must be at least 13 years old to use MistNovel. If you are between 13 and 17, you must have parental or guardian consent to use the Service. If we learn you are under 13 and have not obtained such consent, we will terminate your account and delete your data.
1.2 Account Registration You may register using a Gmail (Google) account. You must provide accurate and complete information during the registration process.
1.3 Account Security You are responsible for maintaining the confidentiality of your account credentials. You accept full responsibility for all activities that occur under your account.
1.4 Account Termination You may delete your account at any time. We reserve the right to suspend or terminate accounts at our sole discretion for violations of these Terms.

2. ZONES OF CONTENT: NOVEL AND SHORT STORY

2.1 Free Zone (Fanfiction & Community)
  • Fanfiction and community works are posted free of charge as "non-commercial transformative works."
  • This content must not be monetized—there are no paywalls, locked chapters, or premium tiers permitted in this zone.
  • While we may host site-wide advertising, if a rights holder issues a valid takedown request, we will remove the fanwork promptly.
  • Fanfiction content is user-generated and remains the sole responsibility of the uploader.
2.2 Premium Zone (Original Novels & Licensed Short Stories)
  • Only creators who own or have licensed full rights may publish in the Premium zone.
  • All creators must sign a Digital Creator Agreement specifying distribution rights and revenue share.
  • Premium works (both long-form Novels and Short Stories) may be monetized via subscriptions, chapter purchases, or other approved mechanisms.
  • The Service maintains strict separation: fanfiction content may never be part of monetized premium content.

3. USER CONTENT & LICENSE

3.1 Ownership You retain all rights and title to the stories, characters, and text you upload ("User Content"), subject to the licenses granted herein.
3.2 License to MistNovel By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your content within the Service.
3.3 Representations and Warranties You warrant that you own your User Content and that it does not infringe upon any third-party intellectual property, privacy rights, or local laws.

4. CONTENT REMOVAL & DMCA

4.1 Right to Remove We reserve the right (but not the obligation) to remove any User Content that violates these Terms or is deemed objectionable by our moderation team.
4.2 Copyright Infringement (DMCA) We comply with DMCA provisions. If you believe your copyright is being infringed, please notify us at: contact@mistnovel.com.
4.3 Repeat Infringers We implement a "three-strike" policy and will permanently terminate the accounts of repeat infringers.

5. PROHIBITED CONDUCT

You agree not to use the Service to:
  • Upload illegal, pornographic, violent, defamatory, or harassing content.
  • Use bots, scrapers, crawlers, or any automated tools to access the Service.
  • Circumvent security, access controls, or payment mechanisms.
  • Engage in spam or commercial solicitation within the Free Zones.

6. MONETIZATION & SUBSCRIPTIONS

6.1 Payment Processing All payments (for membership, coins, or tickets) are processed through third-party providers such as the Apple App Store or Google Play Store. MistNovel does not store full payment card details.
6.2 Short Story Membership MistNovel offers the "Short Story Membership" (available in Weekly, Monthly, or Yearly plans), granting unlimited access to premium Short Stories and an ad-free experience.
6.3 Introductory Offers We may offer discounted rates for new users. After the offer period, the subscription automatically renews at the standard rate unless cancelled.
6.4 Auto-Renewal Subscriptions renew automatically at the end of each billing cycle. Your account will be charged within 24 hours prior to the end of the current billing cycle.
6.5 Cancellation and Refunds You can cancel auto-renewal at any time in your App Store or Google Play settings. To avoid charges, you must cancel at least 24 hours before renewal. Purchases are generally non-refundable.
6.6 Restore Purchases If you reinstall the app or change devices, use the "Restore" button on the Membership page to reactivate your subscription. You must use the same Apple ID or Google Account.

7. LIMITATION OF LIABILITY

7.1 "As Is" Basis The Service is provided "as is" and "as available." AYA Pte. Ltd. makes no warranties regarding uptime, accuracy, or freedom from errors.
7.2 Limitation of Damages In no event shall we be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including data loss or service interruptions.

8. GOVERNING LAW & JURISDICTION

8.1 Governing Law These Terms are governed by and construed in accordance with the laws of Singapore.
8.2 Dispute Resolution Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts located in Singapore.

9. CHANGES TO TERMS

9.1 Updates We may revise these Terms from time to time. The "Last Updated" date will be updated accordingly.
9.2 Acceptance Your continued use of MistNovel after an update constitutes your explicit acceptance of the revised Terms.
